What Comes Next?
The hemp industry’s fight is far from over.
Attention is now turning toward Washington, where additional federal hemp reforms are expected to take effect later this year. Those changes would move federal hemp regulation toward a “total THC” standard rather than measuring only Delta-9 THC—a change that could further reshape the industry nationwide if implemented.
At the same time, Texas lawmakers and industry groups continue debating whether the state should regulate intoxicating hemp products rather than prohibit large portions of the market.
For now, however, the message from law enforcement is clear:
Products that were commonly sold in Texas just days ago may now expose consumers and retailers to serious criminal penalties.
The Blazed Take
The Texas hemp industry built thousands of businesses including ours; and supported tens of thousands of jobs under rules established after the 2018 Farm Bill and Texas House Bill 1325. This sudden shift in enforcement has created uncertainty for retailers, absolute confusion for consumers!
Whether future court challenges, legislative action or federal reform change the landscape again remains to be seen. Until then, Texans should will be forced to the black market for THC, including online sales from out of state!
Unfortunately the legal environment surrounding hemp-derived THC products has so changed dramatically—and and with such dramatic effects that sadly products that once sat openly on store shelves may now carry significant harsh legal risk.
